In India, on an average, the process to get a trademark registered takes 6-12 months from the date of application. However, as soon as application is filed, the applicant is entitled to use the symbol TM with their brand name.
A trademark can fall into 45 different classes (1-34 are for goods, and 35- 45 are for services). Basis your goods/ services, it is important to determine the correct class. Our experts can guide you with finding the appropriate class for your trademark.
A flowchart representation of the process to get a trademark registered has been given hereinabove. The same can also be downloaded for reference.
A logo containing the brand name can be filed for registration as a whole, along with a tag line, if any in a single application. The logo and brand if applied for registration separately, will be considered two separate applications resulting in extra costing for the applicant.
The symbol TM can be used by an applicant as soon as trademark application is filed and an acknowledgement thereof is received. Once the process of trademark registration is complete, and the trademark certificate is generated, the applicant can start using the symbol ® .
Trademark availability search can be undertaken on government’s IPR website. It requires various parameters to be analysed for filing a new brand name. You can get a free trademark search report from Mark My Brand. All you need is to fill in the form above.
Prima- Facie, in case your brand name is already registered under a different class, you can still apply for its registration in other class. However, various parameters still needs to be ensured before proceeding for filing.
Trademark rights are established from use rather than from application filing. Hence, primarily even if someone has already applied your trademark or a similar mark for registration, you may still proceed for filing. Our experts at Mark My Brand shall be happy to advise you basis the facts of your case.
A trademark is an intangible asset. Hence, being an intellectual property of the owner, it can be sold or purchased just like other properties. In case you wish to purchase or sell any brand, you can get in touch with Mark My Brand team.
A trademark registration can be applied for any word, device, logo, name, numerals, label, or a combination of colours that can be represented graphically. It is also important that the trademark which is applied for registration has to be distinctive for the goods or service under which it is proposed to be registered.
For getting a trademark registered in India, the following documents are required: • ID proof of the applicant • Contact details • Authorisation by way of Power of Attorney For more details, visit our Trademark registration page
